1. Introduction

#

Who this policy is from and what it covers.

1.1 Overview

This Privacy Policy ("Policy") describes how Radient Inc. ("we", "us", "our") collects, uses, discloses, retains and protects personal information when you use the Radient software, applications and services, including our downloadable software, hosted services and documentation (together, the "Services").

1.2 Accepting this policy

By accessing or using the Services, you acknowledge that you have read, understood, and agree to be bound by this Policy. If you do not agree with it, you must not access or use the Services.

1.3 Changes to this policy

We may modify this Policy at any time. We will notify you of any material change by posting the revised Policy on our website, sending you an email, or providing a notification through the Services. Your continued use of the Services after such a change constitutes acceptance of it. It is your responsibility to review this Policy periodically.

1.4 Children

The Services are not directed to children under the age of 13, or 16 in the European Union, and we do not knowingly collect personal information from children. If you are a parent or guardian and believe your child has provided us with personal information, contact us at [email protected]. If we become aware that we have collected personal information from a child without verification of parental consent, we will remove that information from our servers.

2. What we collect

#

Three sources: what you give us, what your use of the service generates, and what third parties tell us.

2.1 Information you give us

We collect the information you provide to us when you use the Services. This may include:

  • Account information. When you opt into the hosted platform, we collect your name and email address to create and manage your account.
  • Your content. Information, data, text, or other material that you submit, upload, or otherwise make available through the Services, including data processed by AI agents through the Services.
  • Communications. Information you provide when you contact us for support, feedback, or other enquiries.
  • Payment information. If you make a payment through the Services, our third-party payment processors may collect payment card or other financial account information necessary to process it.

2.2 Information we collect automatically

When you use the Services, we may automatically collect information about your device and your use of them. This may include:

  • Device information. Your IP address, device type, operating system, and browser type.
  • Usage information. The features you use, the time and duration of your use, and other usage statistics.
  • Log data. Server logs, which may include your IP address, browser type, operating system, referring and exit pages, date and time stamps, and clickstream data.
  • Cookies and similar technologies. We may use cookies, local storage, and similar technologies to collect information about your use of the Services. You can control cookies through your browser settings and other tools.

2.3 Information from third parties

We may receive information about you from third parties, such as:

  • Model and tool providers. When you use third-party models or tools through the Services, we may receive information from those providers as necessary to facilitate the integration and provide the Services.
  • Business partners. We may receive information about you from partners who help us provide, improve, or promote the Services.

3. How we use it

#

To run the service, to talk to you, to improve what we ship, and to meet legal obligations.

3.1 Running and improving the service

We use the information we collect to provide, maintain, and improve the Services, including to:

  • Create and manage your account;
  • Process transactions and send related information, including confirmations and receipts;
  • Provide support and respond to your enquiries;
  • Develop new products, services, features, and functionality;
  • Monitor and analyse trends, usage, and activity in connection with the Services;
  • Detect, investigate, and prevent fraudulent transactions and other illegal activity, and protect the rights and property of Radient Inc. and others.

3.2 Communications

We may use your information to communicate with you about:

  • Updates to the Services, including new features, functionality, or content;
  • Responses to your comments, questions, and requests;
  • Technical notices, updates, security alerts, and support and administrative messages;
  • Marketing and promotional messages, if you have opted in to receive them.

3.3 Research and analytics

We explicitly affirm that Google Workspace APIs are not used to develop, improve, or train generalized or non-personalized AI or ML models. All data processing for research and analytics purposes complies with applicable privacy laws and is limited to improving the Services as described in this Policy.

We may use your information for research and analytics, such as to understand how people interact with the Services, to improve the experience, and to develop new features and functionality.

We may use your information to comply with applicable legal obligations, including responding to lawful requests from public authorities.

4. Who we share it with

#

Service providers, API providers, and the cases where the law requires disclosure.

We may share your information with third parties when you have given us your consent to do so.

4.2 Service providers

We may share your information with third-party service providers who perform services on our behalf, such as hosting, data analysis, payment processing, customer service, email delivery, and auditing. These providers are contractually obliged to use your information only as necessary to provide services to us, and are prohibited from using or disclosing it for any other purpose.

4.3 API providers

When you use third-party models or tools through the Services, we may share the information necessary to facilitate the integration and provide the Services. Those providers' use of your information is governed by their own privacy policies.

4.4 Business transfers

If we are involved in a merger, acquisition, financing, reorganization, bankruptcy, or sale of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.

We may disclose your information where required to do so by law, or in response to a valid request by a public authority such as a court or government agency. We may also disclose your information to:

  • Enforce our Terms and other agreements;
  • Protect and defend our rights and property;
  • Prevent or investigate possible wrongdoing in connection with the Services;
  • Protect the personal safety of users of the Services or the public;
  • Protect against legal liability.

4.6 Aggregated and de-identified data

We may share aggregated or de-identified information, which cannot reasonably be used to identify you, with third parties for research, marketing, analytics, and other purposes.

5. Retention and security

#

How long we keep information, how we protect it, and what happens if it is exposed.

5.1 Retention

We retain your personal information for as long as necessary to fulfil the purposes for which we collected it, including to satisfy any legal, accounting, or reporting requirement. To determine the appropriate retention period we consider the amount, nature, and sensitivity of the information, the potential risk of harm from unauthorized use or disclosure, the purposes for which we process it, whether we can achieve those purposes by other means, and the applicable legal requirements.

See the Data and privacy answers in the FAQ

5.2 Security

We implement technical and organizational measures to protect the security of your personal information. These include:

  • Encryption of personal information, in motion and at rest;
  • Firewalls and secure server infrastructure;
  • Access controls and authentication procedures;
  • Regular security assessments and audits;
  • Employee training on data protection and security practices.

No method of transmission over the internet and no method of electronic storage is completely secure. While we use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security.

5.3 Breach notification

In the event of a data breach affecting your personal information, we will notify you and the relevant authorities as required by applicable law. We will tell you what happened, what information was affected, and the steps you can take to protect yourself.

6. Your rights and choices

#

Access, portability, deletion, restriction, withdrawing consent, marketing, cookies and Do Not Track.

6.1 Access and correction

You have the right to access and correct your personal information. You can review and update much of it by signing in and opening your account settings. For anything that cannot be reached there, contact us at [email protected].

6.2 Portability

You have the right to request a copy of your personal information in a structured, commonly used, machine-readable format, and to ask us to transfer it to another party where that is technically feasible.

6.3 Deletion

You have the right to request that we delete your personal information. You can exercise it yourself: the Account page in the Radient console deletes your account and personal data immediately once you confirm by typing your email address. There is no undo. If you cannot sign in, contact us at [email protected] and we will carry out the same deletion for you.

Deleting an account erases your personal information. What we keep is limited to:

  • Billing, invoice, and credit records with your personal details removed, kept as required for tax, legal, and accounting purposes;
  • A non-reversible hash of your email address, kept with the record of the deletion so the same address cannot claim the free credit again;
  • Signup fraud-prevention records, including the IP address recorded when you signed up, which is kept for 90 days.

6.4 Restriction and objection

You have the right to ask us to restrict the processing of your personal information, or to object to it. Exercise either right by contacting us at [email protected].

Where we process your personal information on the basis of your consent, you have the right to withdraw that consent at any time. Withdrawing consent does not affect the lawfulness of processing carried out before the withdrawal, nor processing carried out in reliance on a lawful basis other than consent.

6.6 Marketing email

You can opt out of marketing email by following the unsubscribe instructions in any marketing message, or by contacting us at [email protected].

6.7 Cookies

Most browsers accept cookies by default. You can set your browser to remove or reject them. If you do, some parts of the Services may not be available or may not work as intended.

6.8 Do Not Track

Some browsers have a "Do Not Track" feature that signals to the sites you visit that you do not want your online activity tracked. There is no consistent industry standard for responding to these signals, and we do not currently respond to them.

7. International transfers

#

Where your information may be processed and the safeguards we apply.

7.1 Transfers

Your personal information may be transferred to, and processed in, countries other than the one you live in, and those countries may have different data protection laws. Our servers are located in several countries, and our service providers and partners operate globally.

7.2 Transfer safeguards

Whenever we transfer your personal information out of your country, we apply safeguards intended to give it a similar degree of protection, such as:

  • Transferring to countries recognized as providing an adequate level of protection for personal information;
  • Using contracts approved by the relevant authorities, such as the European Commission's Standard Contractual Clauses, that give personal information the same protection it has in your country;
  • Implementing additional safeguards required by applicable law.
